Do I Have A Case?
A frequently asked question is, do I have a case? As a general rule, this question cannot be answered without some preliminary questioning and investigation. Most lawyers will first of all need to do an investigation of the facts surrounding the issues of liability and damages.
Liability is established under Iowa Negligence Law when you can establish that the other party was 50% or more at fault in causing your injuries. Fault is defined as conduct which amounts to negligence. Negligence means failure to use ordinary care. Ordinary care is the care which a reasonably careful person would use under similar circumstances.
There are other types of fault which if you can prove, will give rise to your having a case. For example, were your injuries caused by a defective product which was unreasonably dangerous? Alternatively, were you injured because a condition on a premise was unreasonably unsafe.
There is no simple answer to the question, do I have a case.
